How are General damages calculated?
General damages are capped under the Civil Liability Act 2003 and determined using an Injury Scale Value (ISV) outlined in the Civil Liability Regulation 2014. Injuries are rated from 0 (no damages awarded) to 100 (most severe).
To assess pain and suffering, accident-related injuries are categorised using medical information, matched to an ISV range, and converted into a dollar value using guidelines contained in the Regulations.
